In January 2014, the Empire State Building’s operators sued photographer Allen Henson over a photo shoot with a topless adult model at its observatory. The operators sought $1.1 million and alleged that the shoot breached their rules. Gothamist’s report at the time carried the claim and Henson’s response.

An August 2014 New York court order denied Henson’s motion to dismiss the operators’ trespass claim, dismissed his defamation counterclaim and denied the operators’ early sanctions request. That is an interim ruling, not a statement of the final outcome or an award of the amount sought. The archive photograph is credited to Allen Henson.
